Welcome to the Eighth Court of Appeals

El Paso, Texas

VIDEO CONFERENCING EQUIPMENT.   This court offers video conferencing equipment for oral argument of cases transferred from the Dallas, Ft Worth, and San Antonio Court of Appeals. Cases in which oral argument is granted will be set and heard via video conferencing equipment and the parties will be advised of the location when they are advised of the submission date. However, any party may elect to appear in person (El Paso) and must contact this court, upon receiving notice of the oral argument, if their preference is to appear in person. The parties may indicate their preference when their brief is filed.

The Eighth Court of Appeals was created by the legislature in 1911. The Court is composed of a Chief Justice and two justices and has appellate jurisdiction of both civil and criminal cases appealed from district and county courts in the 17 counties listed below; in civil cases where the judgment exceeds $100, exclusive of costs, and in criminal cases, except in post-conviction writs of habeas corpus and where the death penalty has been imposed. Death penalty cases are appealed directly to the Texas Court of Criminal Appeals in Austin. The Court also has jurisdiction over original proceedings from those 17 counties such as Writs of Mandamus, Injunction, Prohibition and Habeas Corpus.

The State of Texas is divided into fourteen courts of appeals districts. Each court has a chief justice and at least two justices. Texas has eighty justices serving on the fourteen courts of appeals. The Eighth Court of Appeals is located in El Paso County.
